Three Ways We’re Simplifying the Exclusion Waiver Process

When owners choose to be excluded from their workers' compensation policy, the law requires them to sign and return an exclusion waiver form.

In February 2026, we made several changes to the State Fund Online broker portal to help excluded owners get and return waiver forms more quickly. This ensures your clients can complete and submit the needed forms in time to keep their exclusion status and prevent unwanted changes to their policies.

Key improvements

  • Faster waiver delivery. When you enter details for an excluded owner in the broker portal, the system now asks for an email address (optional) for that owner. If it is provided and the submission is quoted in the portal, the portal sends an exclusion waiver email to the owner once the policy is bound. This makes waiver delivery faster and easier.
  • Better post-bind control. We updated the post-bind section for exclusion waivers, giving you better control over sending waivers to excluded owners of newly bound policies. You can now see which owners already received a waiver from BindNow and email the waiver to owners or primary contacts who need one.
  • Clearer waiver emails. We also improved the email that delivers the waiver form (as an attachment). It now clearly explains why the waiver matters, stresses the need to return it by the due date, and includes an email address for sending the signed waiver. The email also tells the owner to cc the broker when sending the completed waiver, so you can track the status of the task.

Future enhancements

We’re rolling out more improvements over the coming months. One major change will add e-signature support for waiver forms. This will let excluded owners open and sign their waivers online, so they no longer need to print, scan, and email the forms.
